US forced labor law establishes new compliance paradigm

On 21 June, the Uyghur Forced Labor Prevention Act1 (“UFLPA”) – with its hallmark “rebuttable presumption” regarding goods from the Xinjiang Uyghur Autonomous Region (“XUAR”) – came into effect in the United States. Coupled with new guidance from the Department of Homeland Security (“DHS”) and the publication of an enforcement strategy (“the Strategy”) as required under the law, UFLPA establishes a significant new compliance paradigm for the business community.
